Thompson appeals to Supreme Court

Former Crawford police chief Richard Thompson was set to appear in Dawes County District Court Tuesday afternoon for an arraignment on felony assault charges in the shooting death of 16-year-old Jesse Britton last October. However, his attorneys have filed a notice of appeal asking the Nebraska Supreme Court to overrule Judge Randall Lippstreu’s decision to deny Thompson’s motion to dismiss, quash and plea in abatement.
Lippstreu denied Thompson’s motions last week and ordered him to appear in court Tuesday. The appeal to the Supreme Court will delay criminal proceedings in the case while the justices decide whether or not to hear the appeal.
The Supreme Court can refuse to hear the appeal and return the case to Dawes County to proceed or choose to take up the matter. Should the Supreme Court decide to hear the case, they can say Lippstreu was correct in his ruling or overturn his decision. If Thompson’s motions are granted at the Supreme Court level, the state has the possibility of re-filing the case or convening another grand jury in the matter.
